All work is compensated at the above hourly rate except for the following work activities which may be compensated on a piece rate productivity incentive basis according to the following schedule: Harvesting sweet potatoes: $0.45 per 3 gallon bucket No piece rate compensation will be lower than the prevailing piece rates in the area of intended employment. In the event that the SWA/DOL promulgates new prevailing piece rate(s) lower than the piece rates stated above, the employer reserves the right to pay the new, lower piece rate(s) for the applicable crop(s). When work is performed according to the stated piece rate schedule, workers are guaranteed that they will be paid no less than the applicable H-2A hourly rate for each hour worked. The employer may, in its sole discretion, raise or suspend the piece rate scheme in favor of hourly pay at the applicable H-2A hourly rate in order to assure fair earnings. Please note, in light of the Department of Labor's position that where an employer has staggered dates of need, the employer must file a separate application for each date of need, Lewis M. Bailey IV Farms Inc. has already filed one or more earlier applications reflecting a portion of their regularly recurring cumulative labor need.
