The Department of Labor recently announced new minimum wage rates, called Adverse Effect Wage Rates (AEWRs), that employers must offer and pay, at the time work is performed, to nonimmigrant H-2A workers and workers in corresponding employment beginning on the effective date of the new wage rates. Job Duties:
Harvesting specifications can change from time to time during the season due to crop or market conditions, even on the same crop. Workers will be expected to conform to the specific instructions given for each days work. Work begins at an assigned time shortly after daylight. Work is performed during light rain and in high humidity and in temp ranging from 100 degrees to 35 degrees F. Workers will work on their feet in bent positions for long periods of time. Workers will lift for prolonged periods of time and must be physically fit and able to perform the duties as described. All the tasks in the Job Description constitute one (1) job; the employer may assign workers to different tasks on any day or to multiple tasks during the same day in the sole judgment of the employer.Workers may be required to preform work, on the farm, that is incidental to farming the crops listed in the application, such as performing hand cultivation tasks, weeding or hoeing, cleaning and repairing farm buildings, weed beds, rake grounds, operate tractor/farm equipment incidental to crops, clean fence rows and weed eating around barns and other out buildings, and fence rows, painting barns and fences, weeding, etc ... This is a very demanding and competitive business in which quality specifications must be adhered to. Sloppy work cannot and will not be tolerated. Stripping Booking and Stripping: When the tobacco has cured and ready to start stripping the workers will remove tobacco sticks from rails in barn, then remove the stalks from the sticks and transport tobacco to a stripping room. The tobacco is placed on a bench in the stripping room where the workers will remove the leaves from each stalk. In the stripping room there will be at least 4 large metal rings that are about 2 feet deep and covered with large canvas type sheets. The worker stands in this ring and removes the leaves according to the grade of tobacco he is pulling and then passes the stalk to the next person who removes the leaves he is grading and so on until the leaves are all pulled from the stalk. The leaves the worker is pulling will be dropped in the ring in which he/she is standing. As he/she pulls the leaves he is tamping the leaves down with his feet and when the ring is full a worker will pull the corners of the sheet together and remove from ring and place another sheet in the ring, and the tobacco leaves in bailing machine. Worker will operate controls of bailing machine pressing the leaves down until it reaches the required weight and place the grade number on bale as instructed by the employer.

The employer will train the workers for a period of two day after which the worker will be expected to work without constant supervision. Tools and Equipment: The employer will furnish, without charge, all tools, supplies, and equipment required in the performance of the specified work. Workers will be charged for any willful damage or loss of such tools and equipment. Drug Testing The employer reserves the right for probable cause to conduct random drug testing on any employee after being hired. If the employee is positive for any drugs or refuses to take a drug test, the employee will be subject to dismissal. This testing will be at the total expense of the employer
