The Department of Labor recently announced new minimum wage rates, called Adverse Effect Wage Rates (AEWRs), that employers must offer and pay, at the time work is performed, to nonimmigrant H-2A workers and workers in corresponding employment beginning on the effective date of the new wage rates. Job Duties:
Workers will perform assigned duties as instructed by their supervisor. Duties may vary from time to time and may include all of the following job specifications. Drive and Service Tractors: The workers are required to service and maintain all machinery that they will be used to preform assigned tasks. This will include but is not limited to checking and maintaining all fluid levels, filling fuel tanks, greasing all Zerk fittings, blowing out debris from air filters and radiators, cleaning windows, and maintaining the general cleanliness of the equipment’s day-to-day functionality. Disking Fields: Workers will disk fields during pre-crop and post-crop activities. Supervisors will instruct the workers on the frequency and direction of field disking. Harvesting: Workers are required to operate a tractor pulling a field wagon. The workers will load the wagon with empty pallets, empty the crates with either a forklift or by hand, and move the crates to the field. Workers will safely back the wagon up while maintaining contact with the mule train as the wagon is loaded. Workers will then move the loaded wagon to the ramp to offload the loaded pallets. This process will be repeated throughout the day. Cultivation: The worker will use a tractor and cultivator to cultivate fields in an appropriate and safe manner. The worker will be required to maintain this equipment. Fertilizing: Workers will be required to maintain tractors and fertilizer equipment, and to use equipment to fertilize the corn as directed by their supervisor. Forklift: Workers will be required to operate a forklift for purposes, which include, but are not limited to, the loading and unloading of pallets for the field wagons and the trucks. Topper: Workers are required to maintain the topping equipment, and to use equipment to top the corn as directed by their supervisor.
