The Department of Labor recently announced new minimum wage rates, called Adverse Effect Wage Rates (AEWRs), that employers must offer and pay, at the time work is performed, to nonimmigrant H-2A workers and workers in corresponding employment beginning on the effective date of the new wage rates. Job Duties:
Workers will clean, grade, sort, pack and load harvested crops including seed corn. Worker will place, not drop, product into harvest container and when full carry container to the designated area and either exchange for empty container or empty container then return to row and repeat process. Workers that qualify may be required to operate Agriculture Machinery and power equipment including but not limited to: tractors, planters, fork lifts, skid loaders and farm vehicles to haul seed corn from the field to the indoor pack house/warehouse. Workers must operate all equipment properly and in a manner that protects operator, others, the employers products and property. Failure to comply with safety requirements and operating instructions may result in disciplinary action up to and including immediate termination. Workers are expected to perform duties including loading of product and farm maintenance. Workers with a clean MVR and able to obtain an insurable driver's license may be requested to drive company vehicles. No workers will be terminated for failure to obtain a driver’s license. Sanitation Requirements: For food and general personal safety purposes, all workers will be required and expected to follow common sanitary and GAP practices at all times. Employees are required to cleanse their hands by washing them thoroughly with soap and water after using the bathroom and before entering fields or for harvest activities of the packing facility for packing operations. Weekly and hourly work schedules in Boxes A.6 and A.7 are merely approximate; actual hours will depend on weather and needs of the growers. Workers may work in shifts/crews starting at 7 am.
