The Department of Labor recently announced new minimum wage rates, called Adverse Effect Wage Rates (AEWRs), that employers must offer and pay, at the time work is performed, to nonimmigrant H-2A workers and workers in corresponding employment beginning on the effective date of the new wage rates. Job Duties:
This application is filed for workers to be employed under the SOC Code 45-2041 Graders Sorters Agricultural Products. Work will be performed exclusively in the sweet potato packing operation facilities owned and controlled by Barnes Farming Corporation located in Spring Hope NC. There will be no growing operation work activities performed by these employees of Barnes Farming Corporation at any time during this period of employment. This job order is for Barnes Farming Corporation sweet potato packing operations and ONLY in the job descriptions listed below. All the sweet potato packing work activities will be performed at the Barnes Farming Corporation facility located on the farm in Spring Hope NC. 90%+ of the sweet potatoes that will be packed have been grown by Barnes Farming Corporation and in no single work week, or weekly pay period, will the percentage of Barnes Farming Corporation grown sweet potatoes packed fall below 60%. During a single pay period when workers employed under this application perform work activities described herein on sweet potatoes grown by an entity other than Barnes Farming Corporation, the workers will be paid overtime (time and ½) at the highest applicable hourly rate for any hours worked over 40 hours in accordance with the Fair Labor Standards Act provisions governing the same. There are no work activities listed, described or performed that changed the nature of the sweet potatoes being packed between the field harvest and loading on trucks for transport to the marketplace; no cooking, no preserving or processing of any kind. This is exclusively agricultural employment with absolutely no elements of manufacturing.
