- This business is a company in the seasonal retail sales of Pumpkins and Christmas Trees industry. My parents, Norm & Linda Osborne, founded this company in 1992, when they purchased the retail assets of Pinery Tree Farm.
After graduating from College in 1996, I joined the company. We expanded the scope of our operations in 1999, by opening the first of seven Pumpkin Station locations.
In 2007, the Pinery purchased the assets of Del Mar Christmas Trees, making us the largest independent retailer of Christmas Trees in Southern California. A specific location may be in operation for Pumpkin Sales, Christmas Tree Sales, or both. The locations would be open during the Halloween, Thanksgiving and Christmas Seasons, from August through December.
We have a seasonal need for these workers, recurring on a predictable annual basis. This is because the products that we sell are tied to specific seasonal events (Halloween, Thanksgiving and Christmas) and we are only open for retail sales during this period of time and our retail lots are closed from January through July of each year.
The number of workers required to operate our business is obviously dictated by the demand for products at our various seasonal locations, the hours of operation, and the number of workers that are required to safely (for the workers themselves, their fellow workers and for the public) maintain and operate those seasonal locations. These are the factors that I take into consideration as I calculate my need for workers so that I can accurately complete this application process, remain compliant with and strive to protect the integrity of this vital H-2B non-immigrant foreign worker program.
We have requested 8 workers to start in August and end in December, and then we file a second petition for 6 workers to start in October and end in December, because business picks up closer to Halloween, Thanksgiving and Christmas.
Our temporary need for Temporary Foreign Workers is seasonal, predictable and recurrent annually.
In the current application, we have calculated and are filing for 6 Seasonal Retail Salespersons for the period October 1, 2022 through December 31, 2022. FY21 we were delayed in our filing process, so for FY22 we have shifted our Start Dates back to pre-Covid seasonal need; therefore, we are submitted two separate applications for our two separate seasonal needs as we had done before the pandemic disrupted our business beyond our control.
FY22 we filed with your department and were certified for 8 Seasonal Retail Salespersons for the period August 10, 2022 through December 31, 2022, certificate H-400-22147-219160.
FY21 we filed with your department and were certified for 12 Seasonal Retail Salespersons for the period August 21, 2021 through December 31, 2021, certificate H-400-21158-375274.
FY21, we did not file for the period October 1, 2020, through December 31, 2020, due to reduced need for labor as we were under severe operational limitations due to the Covid-19 pandemic. This anomaly does not ..PLEASE SEE ATTACHED STN......................
