The Department of Labor recently announced new minimum wage rates, called Adverse Effect Wage Rates (AEWRs), that employers must offer and pay, at the time work is performed, to nonimmigrant H-2A workers and workers in corresponding employment beginning on the effective date of the new wage rates. Job Duties:
This job requires a minimum of 3 months of agricultural equipment operation experience. The lifting requirement for this position is 60 pounds. Worker may: • Drive and control equipment to support agricultural activities such as tilling soil; planting, cultivating, and harvesting crops; feeding and herding livestock; or removing animal waste. • May perform tasks such as crop baling or hay bucking. • May operate stationary equipment to perform post-harvest tasks such as husking, shelling, threshing, and ginning. • Load and unload crops or containers of materials, manually or using conveyors, handtrucks, forklifts, or transfer augers. • Mix specified materials or chemicals, and dump solutions, powders, or seeds into planter or sprayer machinery. • Spray fertilizer or pesticide solutions to control insects, fungus and weed growth, and diseases, using hand sprayers. • Observe and listen to machinery operation to detect equipment malfunctions. • Manipulate controls to set, activate, and adjust mechanisms on machinery. • Operate or tend equipment used in agricultural production, such as tractors, combines, and irrigation equipment.

For purposes of this paragraph, payment includes, but is not limited to, monetary payments, wage concessions (including deductions from wages, salary, or benefits), kickbacks, bribes, tributes, in kind payments, and free labor. This provision does not prohibit employers or their agents from receiving reimbursement for costs that are the responsibility and primarily for the benefit of the worker, such as government-required passport, or visa fees. Worker will be reimbursed should the worker receive a visa and arrive at the place of work.
