Job Duties:
Workers will perform assign duties as instructed by their supervisor. Harvesting of vegetables: Once at the picking location, doing a row at a time, workers will move down the rows plucking the vegetables from the plants and putting them in a container. Once the container is full the worker will take the container to the truck and dump the content. The worker will go back to his picking area and fill his container up again, repeating the process through the work day. Packing vegetables: trucks will take the vegetables to the packing house where they will be washed and put in a conveyor belt, workers will stand by the conveyor belt and remove the bad vegetables, the conveyor belt will take the vegetables through the sizing machine to separate by size, workers will stand at the end of the sizing machine and will put the vegetables in bags and the bags will be placed on pallets. Field Maintenance: workers will tie, stake and prune plants, clean micro jets and remove plastic drip lines, using hands or a hoe workers will remove dead plants and weeds. Note: The packing house is located inside the Farm and more than 50% of the product processed is produced by the Fixed Site Employer. Workers must be able to perform strenuous manual labor outdoors in all weather conditions, including heat, cold, and rain, for a minimum of six (6) hours per day. The position requires physical strength and endurance to bend, stoop, and stand for extended periods, as well as manual dexterity to repetitively use hands at a sustained pace to meet production standards. The employer will provide all necessary tools and equipment at no charge to the worker. Consistent with applicable law, the employer may recover the reasonable cost of repair or replacement of tools if damage results from the worker’s willful misconduct or gross negligence after the damage has occurred and after gaining the employee's written authorization to make the deduction. At its sole discretion, the employer may pay a higher wage rate based on individual performance or tenure, which does not alter the entry-level requirements of this position. Employees may volunteer to work additional hours when work is available. While available hours may occasionally exceed the hours offered, such additional hours are not guaranteed. Workers are not required to work beyond the daily or weekly hours stated in the contract, nor on a worker’s Sabbath or federal holidays. Workers should expect occasional periods of little or no work due to weather, crop maturity, or other conditions beyond the employer’s control. These periods may occur at any time throughout the season. Workers will supply their own work clothes. If a worker requests a leave of absence during the contract period while work is available, the hours missed during that leave will be deducted from hours worked but still counted toward the total hours offered under the ETA-790 for purposes of meeting the three-quarter guarantee. A written copy of the work contract, or in the absence of a separate written agreement, the certified ETA Form 790/790A which constitutes the work contract, including any approved modifications, will be provided at no cost to the worker in a language the worker understands. For H-2A workers, the contract will be provided no later than the time of visa application. For workers in corresponding employment, the contract will be provided no later than the first day of work. For H-2A workers transferring to a subsequent H-2A employer, the contract will be provided no later than the time the subsequent offer of employment is made. The employer will maintain documentation evidencing provision of the contract in accordance with applicable federal recordkeeping requirements.
