ETA Case Number:
H-400-26185-078633

Yes
Additional Wage Information:
Offered Wage The offered wage is $20.13 per hour, which equals the prevailing wage established by Prevailing Wage Determination P-400-26097-766391 for SOC 35-3031.00, Waiters and Waitresses, in the Naples-Marco Island, FL area of intended employment. The same wage applies at all four worksite locations, as confirmed by ETA Form 9141 Appendix A. Consistent with the additional notes to that determination, the employer will pay the greater of $20.13 per hour or the actual wage level paid to other employees with similar experience and qualifications for the same position in the same location. Tipped Occupation — How the Offered Wage Is Satisfied Server is a tipped occupation. The employer pays a base hourly wage of $11.98 per hour and applies tips received and retained by the worker toward the balance of the offered wage. If the base hourly wage plus tips received is less than $20.13 per hour in any workweek, the employer pays the difference, so that the worker receives no less than $20.13 per hour, free and clear, for all hours worked. The base hourly wage of $11.98 per hour equals or exceeds the Florida direct cash wage for tipped employees in effect throughout the period of intended employment, which is $11.98 per hour from September 30, 2026. The employer reconciles tips received against the offered wage on a weekly basis and retains records of that reconciliation. Workers retain all of their tips. Any tip pool is limited to employees who customarily and regularly receive tips; supervisors and managers do not participate in any tip pool. Workers receive advance notice of the base hourly wage, the amount of tips credited toward the offered wage, and their right to retain all tips. Wages are paid by direct deposit every two weeks. Overtime Overtime may be available. Overtime hours are paid at $30.20 per hour, which is one and one-half times the regular rate of $20.13 per hour, for all hours worked over 40 in a workweek. Tips are not counted toward the overtime premium. The employer uses a single workweek, Sunday through Saturday, as its standard for computing wages due. Work Schedule The anticipated schedule is 35 hours per week, Wednesday through Sunday, seven hours per day, from 7:00 AM to 3:00 PM, consistent with Section F.a, Items 5 and 6 of the ETA Form 9142B. Days and hours of work vary based on need across the employer’s four club locations. Early mornings, frequent evenings, and weekends, including holidays, work is required. Bonuses, Fringe Benefits, and Other Facilities • Raises and bonuses are available based on performance or length of service with the employer. • Free meals are provided to employees while on duty. • Optional medical and vision benefits are available to employees whose expected period of employment exceeds six months. • An optional 401(k) retirement plan is available to eligible employees following 30 days of continuous employment. • Optional shared employee housing is available for workers relocating to begin employment. If accepted, the cost is $650 per month plus a refundable up-front security deposit of $350. The use of company housing is not a condition of employment. • Daily transportation to and from the worksite is provided at no charge to workers who elect the optional shared employee housing. All other employees are responsible for their own transportation to and from the worksite. • Transportation is provided to all workers to and from the airport upon arrival and to their respective housing units at no charge. • All tools, supplies, uniforms, and equipment required to perform the duties assigned are provided without charge or deposit charge.
